1. The Service

Backlink Target ("we," "us," "our") provides backlink intelligence software, including SERP analysis, competitor backlink reports, keyword research, and optional link fulfillment ordering (the "Service"). By creating an account or using the Service, you agree to these Terms.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years old to use the Service.

3. Subscriptions and Billing

• Paid plans are billed monthly in advance. Prices are listed on our pricing page.
• Report quotas reset on each billing cycle. Unused reports do not roll over.
• Subscriptions auto-renew until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period.
• All payments are non-refundable. We do not offer refunds for any reason, including partial billing periods, unused reports, or dissatisfaction with results, except where required by law.
• Payment is processed by Stripe. We do not store your full payment card details.

4. Link Fulfillment

Where the Service offers link placement ordering, we act as an intermediary arranging placements through third-party providers. We do not guarantee specific ranking outcomes, indexing timelines, or that any particular placement will be accepted by a publisher. Link fulfillment orders are non-refundable once placement work has begun.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Scrape, crawl, or programmatically access the Service except through features we explicitly provide.
• Resell, sublicense, or redistribute the Service or its data outputs without our written permission.
• Use the Service to generate spam or manipulative content at scale.

6. Data and Estimates

Backlink metrics, domain authority scores, search volumes, ranking estimates, and all other data are derived from third-party providers and our own models. All data is provided for informational purposes only and may be inaccurate, incomplete, outdated, or entirely wrong. You may not rely on any data from the Service for business decisions. We expressly disclaim any duty to verify, update, or correct data.

7. No Guarantees of Any Kind

We make no guarantees regarding search engine rankings, traffic levels, domain authority changes, indexing, or any business outcome from using the Service or from links placed through it. All data, scores, estimates, and recommendations are provided for informational purposes only. You assume all risk for decisions made based on the Service. Past performance of any metric does not indicate future results.

8. Intellectual Property

The Service, including its software, design, and content, is owned by us and protected by intellectual property laws. Reports generated for your account are licensed to you for your internal business use. You may not publish, share, or distribute report data publicly without our permission.

9. Termination

We may suspend or terminate your account at any time, for any reason or no reason, with or without notice. Upon termination for any reason, you are not entitled to a refund, data export, or continued access to any reports or history. Termination decisions are final and not subject to appeal. Upon termination, your right to use the Service ceases immediately. Sections 6–12 survive termination.

10. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability for any and all claims arising from or related to the Service shall not exceed the lesser of (a) the amount you paid us in the 3 months preceding the claim, or (b) $100. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, rankings, traffic, revenue, data, or business opportunity, even if advised of the possibility of such damages. Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Dispute Resolution; Binding Arbitration; Class Action Waiver

Any dispute arising from these Terms or the Service shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in Dallas County, Texas, and not in court. You waive any right to a jury trial. You further agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. If this waiver is found unenforceable, the dispute shall be resolved in the state or federal courts located in Dallas County, Texas.

13. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes will be resolved in the state or federal courts located in Dallas County, Texas.

14. Service Modifications

We may modify, suspend, or discontinue any aspect of the Service at any time without notice or liability. We may change pricing, plan features, report quotas, or data sources at our sole discretion. Continued use after changes constitutes acceptance.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes take effect constitutes acceptance.

16. Indemnification

You agree to indemnify, defend, and hold harmless Backlink Target, its owners, officers, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of the Service, (b) your violation of these Terms, (c) any decisions you make based on data or recommendations from the Service, including any search engine penalties, manual actions, or ranking losses, and (d) any dispute between you and any third party. This obligation survives termination.

17. Your Responsibility for SEO Compliance

You are solely responsible for ensuring your use of the Service and any links acquired through it comply with all applicable search engine guidelines, laws, and regulations. We provide data and fulfillment logistics only. We do not provide SEO advice, and nothing in the Service should be construed as such. Any link building strategy you pursue is entirely at your own risk.

18. No Fiduciary Duty; No Partnership

Nothing in these Terms creates a fiduciary, agency, partnership, joint venture, or employment relationship between you and us. We owe you no duty beyond what is expressly stated herein, and we expressly disclaim any implied duties.

19. Force Majeure

We are not liable for any failure or delay resulting from causes beyond our reasonable control, including but not limited to third-party data provider outages, API changes, internet failures, or actions by search engines.

20. Severability; Waiver

If any provision is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any provision is not a waiver of our right to do so later.

21. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service. No oral or written representations outside these Terms are binding on us.
